  • Operate and improve Linda McClure Co.

I consider the potential impact on your rights before relying on legitimate interests.

Health and special-category information

For ordinary client administration and delivery of services, my Article 6 lawful basis will normally be contract.

For health information and other special-category data, I rely primarily on your explicit consent under Article 9(2)(a) of the UK GDPR.

You will be asked to provide a clear indication of consent before health information is used to deliver personalised nutritional support.

You can withdraw this consent. However, if I can no longer use information necessary to understand your health, I may be unable to continue providing nutritional therapy safely or appropriately.

Information may also be processed where another lawful special-category condition applies, including where necessary to establish, exercise or defend a legal claim or protect someone’s vital interests.

Where services concern a child, information will normally be provided by and communications conducted with a parent or legal guardian.

The person providing the information must have the authority to do so.

Only information relevant to the requested service will be collected. Information concerning children will not be used for marketing.

Where appropriate, the child’s age, understanding and wishes will also be considered.

Information shared during nutritional therapy is treated as confidential.

Identifiable client information will not normally be disclosed without permission unless:

  • A safeguarding concern arises.
  • There is a serious concern about someone’s safety.
  • Disclosure is necessary to establish, exercise or defend a legal claim.

When you pay through the website, Stripe or PayPal may collect:

  • Your name and contact information.
  • Billing information.
  • Payment-card or account information.
  • Transaction, fraud-prevention and device information.

Stripe and PayPal may act as independent Data Controllers for parts of their payment processing. Their use of information is governed by their own privacy policies.

Some service providers may store or process information outside the United Kingdom.

Where required, I will use providers offering an appropriate legal safeguard, such as a UK adequacy regulation, the UK International Data Transfer Agreement, the UK Addendum to approved Standard Contractual Clauses or another permitted transfer mechanism.

Working with a client outside the United Kingdom may also require information to be communicated to that client in their country.

Cookies and analytics

Necessary cookies support the security and operation of the website.

Non-essential cookies, including analytics cookies, will be used only where the required consent has been provided.

Cookie preferences can be accepted, rejected or customised through the cookie banner. Further information is provided in the separate Cookie Policy.

Marketing

Marketing emails will only be sent where you have requested them or another lawful basis permits them.

You can unsubscribe through the link in an email or by contacting linda@lindamcclure.co.

Unsubscribing from marketing will not stop essential messages about an enquiry, purchase, consultation, account, subscription or membership.

Retention

Information is retained only for as long as reasonably necessary for the purpose for which it was collected and to meet professional, insurance, tax, accounting, safeguarding or legal requirements.

Normally:

  • General enquiries that do not become client relationships may be kept for up to 12 months.
  • Adult nutritional therapy records may be retained for up to eight years after the professional relationship ends.
  • Records concerning children may be retained for the longer period required by applicable professional and insurance requirements.
  • Tax, invoice, payment and accounting records are normally kept for at least six years after the relevant financial year.
  • Customer, purchase and membership records may be kept while an account is active and afterwards where required for contractual, accounting, fraud-prevention or legal purposes.
  • Marketing information is retained until you unsubscribe or it is no longer required.
  • Zoom recordings supplied for download are normally removed after seven days.
  • Testimonials may remain published until consent is withdrawn, subject to copies already lawfully produced.
  • Cookie and analytics information is retained for the periods described in the Cookie Policy or provider settings.

Information may be kept for longer where required by law, safeguarding responsibilities, professional insurance or an existing or reasonably anticipated legal claim.

Security

Reasonable technical and organisational measures are used to protect personal information, including access controls, passwords, secure website connections, software updates and reputable service providers.

No online system can be guaranteed to be completely secure. Any personal-data breach will be assessed and handled according to applicable UK data-protection requirements.

Your rights

Depending on the circumstances, you may have the right to:

  • Be informed about how your information is used.
  • Request access to your personal information.
  • Have inaccurate information corrected.
  • Request deletion of information.
  • Restrict certain processing.
  • Object to certain processing.
  • Receive eligible information in a portable format.
  • Withdraw consent.
  • Be informed about applicable automated decision-making.
  • Complain to the Information Commissioner’s Office.

These rights are not absolute. Legal, safeguarding, insurance or professional record-keeping obligations may sometimes require information to be retained.

To exercise a right, email linda@lindamcclure.co. I may need to verify your identity before acting on the request.

Automated decisions

I do not make solely automated decisions about clients that produce legal or similarly significant effects. Nutritional-therapy decisions involve human judgement.

Automated systems may be used for routine functions such as sending purchase confirmations, providing downloads, managing membership access, applying contact tags or issuing appointment reminders.

Third-party websites

This website may link to third-party websites, payment providers, directories or social-media platforms. Their handling of information is governed by their own privacy policies.

Changes to this policy

This policy may be updated when the services, products, website technology or legal obligations of Linda McClure Co change.

The current version will be published on this page with its effective date.
